These terms govern the use of the Lonio marketplace by consumers and businesses in Austria.
These terms and conditions apply to all orders, reservations and bookings concluded through Lonio's website, app or other access channels. Any differing terms of the user do not form part of the contract unless Lonio agrees to them in writing.
Lonio operates a marketplace and facilitates contracts between users and the listed businesses. Lonio does not become a party to the facilitated contract for goods, food, accommodation or services.
An account is required to place orders. Information must be kept complete and accurate. Login details must be kept confidential; suspected misuse must be reported immediately. Lonio may suspend accounts where there is reasonable suspicion of misuse, payment default or repeated unfounded complaints.
All prices are in euros and include VAT. A delivery fee, service fee and small-order surcharge may also apply; these are displayed before the order is completed.
Payment is made using the methods offered at checkout. Lonio collects the amount in the name of and on behalf of the business. Reasonable processing costs may be charged for returned direct debits.
Stated delivery times are estimates based on preparation and travel time. For pickup, the goods must be picked up within the time slot displayed; afterwards, the business may stop making them available. If delivery cannot be made because nobody can be reached at the address provided, the service is considered performed after a 10-minute wait.
Reservations for tables, appointments and rooms are forwarded to the business and confirmed by it. A business may charge a no-show fee for unattended reservations after giving prior notice. Cancellation deadlines are shown for each reservation.
Consumers generally have a right of withdrawal of 14 days for distance contracts. Under § 18 FAGG, this does not apply, among other cases, to:

Statutory warranty provisions apply in relation to the respective business. Please report faulty or missing items within 48 hours through the order in your account; Lonio assists with processing and issues an immediate refund in clear cases.
Reviews may only be submitted after a completed order or reservation. Lonio automatically verifies the link to a receipt and publishes reviews without filtering, but removes unlawful, abusive or obviously untrue content.
Lonio is liable under statutory provisions for damage arising from injury to life, body or health and in cases of intent or gross negligence. For slight negligence, Lonio is liable only for breaches of material contractual obligations and only up to the foreseeable loss. The respective business is responsible for the quality of the services facilitated.
Lonio may amend these terms with effect for the future. Registered users will be informed by email at least six weeks before the amendments take effect. If you do not object before they take effect, the amendment is deemed accepted; the notification will draw specific attention to this consequence.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country of residence remain unaffected. For businesses, the court with subject-matter jurisdiction in Vienna's Inner City is agreed upon.
